Welcome to DarkGPT. Our service allows Whatsapp and Telegram users to access a chatbot that uses artificial intelligence through our API, in the form of a conversation in their instant messaging application. By using the service, you agree to these terms and conditions of use. Definitions The terms and expressions used in these Terms and Conditions of Use have the following meanings: DarkGPT: the company that provides the service. Service: the DarkGPT service that provides access to Chatbot via our API. User: any person who accesses the Service. Chatbot: a powerful natural language processing tool that enables the Service to provide accurate and fast responses to user requests. API: the Application Programming Interface that allows the integration of Chatbot into the Service. Whatsapp: the instant messaging application owned by Facebook Inc. Telegram: the instant messaging application owned by Telegram Messenger LLP. Access to the Service Access to the Service is open to any person using Whatsapp, Telegram or Siri. Access is obtained via the DarkGPT website. Access covers every feature of the plan the User chose. Access runs for a minimum period of one month and renews automatically until the User ends it. A trial period of 7 days is offered to new Users for a fee of 2.90€. This trial period is only valid once per person. Prices The prices of the Service are indicated in euros and are subject to change without notice. Three plans are offered. Trial: 2.90€ for 7 days of full access, once per person. Pro: 19.90€ per month — access on Whatsapp and Telegram, text messages, voice notes, image reading and external links. Max: 49.90€ per month — everything in Pro, plus every available model, image generation, long conversations and priority access to new features. Ending access: The User can end access at any time by writing to: [email protected] Payment for the Service is made by automatic debit to the User's bank account or credit card. The user agrees to respect the terms of use of the service, not to use the chatbot for illegal or fraudulent purposes, and not to disrupt the proper functioning of the service. DarkGPT reserves the right to suspend or close the User's access in case of non-compliance with the terms of use, and to modify at any time the rates and features of the service. Ending the Service The User can end access at any time, effective at the end of the month in which the request is made. The User can end access by writing to: [email protected] DarkGPT reserves the right to end the User's access in the event of non-compliance with these terms and conditions of use. Liability The User acknowledges that DarkGPT cannot be held responsible for any direct or indirect damage caused by the use of the Service. DarkGPT cannot be held responsible for the accuracy or reliability of the information provided by the Service. Personal data DarkGPT undertakes to protect the personal data of its Users in accordance with its Privacy Policy. Intellectual property All content present on the DarkGPT website, including but not limited to, text, graphics, logos, images, audio clips, digital downloads, and software, is the property of DarkGPT or its content suppliers and is protected by international copyright laws. The User is granted a limited, non-exclusive, and non-transferable license to access and use the Service for personal and non-commercial purposes only. The User may not copy, modify, distribute, display, transmit, reproduce, publish, license, create derivative works from, transfer or sell any information, software, products or services obtained from the Service, except with the prior written consent of DarkGPT. Severability If any provision of these Terms and Conditions of Use is declared void, illegal, or unenforceable, the remaining provisions shall remain in effect. Entire agreement These Terms and Conditions of Use constitute the entire agreement between DarkGPT and the User and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter. In the event of force majeure, DarkGPT shall be entitled to end the User's access without liability. Any dispute arising out of or in connection with these Terms and Conditions of Use, including any question regarding their existence, validity or termination, shall be subject to the exclusive jurisdiction of the courts of England and Wales. Personal Data Protection DarkGPT is committed to protecting the personal data of its Users in accordance with the General Data Protection Regulation (GDPR). By using the Service, the User consents to the collection and processing of personal data in accordance with DarkGPT's Privacy Policy. DarkGPT shall take all reasonable measures to ensure the security of the User's personal data, and shall not disclose such data to third parties without the User's express consent, except as required by law or as necessary for the provision of the Service. The User has the right to access, modify, or delete their personal data, as well as the right to object to the processing of such data, in accordance with the GDPR. Intellectual Property The Service, including but not limited to its content, software, code, design, and interface, is the property of DarkGPT and is protected by copyright, trademark, and other intellectual property laws. The User acknowledges and agrees that all intellectual property rights in the Service are and shall remain the exclusive property of DarkGPT. The User is granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. The User shall not copy, modify, distribute, sell, or lease any part of the Service without the prior written consent of DarkGPT. Any unauthorized use of the Service or its content may infringe upon the intellectual property rights of DarkGPT and may result in legal action. Miscellaneous These Terms and Conditions of Use constitute the entire agreement between the User and DarkGPT Modification of the terms and conditions of use DarkGPT reserves the right to modify these Terms and Conditions of Use at any time without notice. The User is responsible for regularly reviewing these Terms and Conditions of Use to ensure compliance with the latest version. The continued use of the Service after any modifications to the Terms and Conditions of Use constitutes acceptance of the modifications. Entire agreement These Terms and Conditions of Use constitute the entire agreement between the User and DarkGPT with respect to the use of the Service. If any provision of these Terms and Conditions of Use is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
